The Decision and Discretion of Vacations Hotel & Resorts in regard to the eligibility of any purchaser for being considered for the Vacations Ownership shall be absolute and beyond contest.

It is understood that all exchange Packages will be available through Vacations Hotel & Resorts on payment of exchange fees. Presently domestic exchange fee is ₹11,500/- per week and international exchange fee is ₹25,500/- per week. All representations set forth within the Brochures and literatures of the organization remain representations of that organization. Neither the company nor its managers will be under any liability in respect of the same. Use by the purchaser(s) of exchange program is voluntary. The Company reserves the right to change affiliation with the exchange Company without the purchaser's approval but without incurring liability, monetary or otherwise towards the Purchaser. All bookings done by Vacations Hotel & Resorts and Hospitality Private Limited only.

Vacations Hotel & Resorts provides an option to instantly convert the payment towards product price into EMI options at applicable rates for selected banks as per terms and conditions of the bank. The Vacations Ownership fee/amount mentioned should be paid via cheque/Credit Card/Debit Card/Online/UPI. Company is not responsible for cash payments made or alleged to be made to company sales persons or anyone.

Availability of Resort & booking is subject to change from time to time and can be confirmed on the basis of real-time online availability.

No request for transfer of confirmation shall be entertained by Vacations Hotel & Resorts.

We understand the terms and conditions of the special enrolment offer(s) chosen at the time of booking for the Vacations Hotel & Resorts package. We understand that any payment made would be appropriated toward the purchase fee and any balance would be payable towards the entitlement.

We understand that in the event of a request for cancellation of Vacations Ownership after the registration period, Clark Vacations shall not be liable to refund any amount paid after the cool-off period of 7 days as per government policy.

The Purchaser agrees to indemnify and keep indemnified Vacations Hotel & Resorts against any loss, damage, claims, costs and expenses which may be incurred or suffered by Vacations Hotel & Resorts in respect of the availability of Vacation under this Offer.

If you suffer injury, illness or death directly as a result of the services provided as part of your holiday, we are not liable to make any payment to you. We will not make any payment if your injury, illness or death was caused by an event or circumstances which the person who caused it could not have predicted or avoided even if they had taken all necessary and due care. We will not make any payment if your illness, injury or death was your own fault.

You should cooperate fully with us if we or our insurers want to enforce those rights.

We reserve the right to refuse to accept you as a customer or continue dealing with you if we, or another person in authority, believe your behavior is disruptive, causes unnecessary inconvenience, is threatening or abusive, you damage property, you upset, annoy, disturb, or put any other traveler or our staff or agents in the resort in any risk or danger.

If our resort staff or agents believe that you could be disruptive, they can refuse to let you proceed with your travel arrangements, restrict your movements, or remove you from your accommodation or excursion. If you are evacuated for your misbehavior, we will treat your booking as cancelled by you from that moment, and you will have to pay full cancellation charges.

Vacations Hotel & Resorts is engaged in the business of Vacations Ownership. We request all customers to review travel warnings, announcements, advisories and prohibitions issued by relevant authorities and governments prior to confirming their international bookings.

All customers are strongly recommended to check and verify their booking thoroughly once they receive the e-mail confirmation. Please contact our travel experts if there is any incorrect or incomplete information. In case of any changes or amendments, certain elements of the vacations package are non-refundable. Vacations Hotel & Resorts cannot be held responsible if inaccuracies are not notified by the passenger within 1 day of sending out the booking confirmation.

The images used in the vacations package on our website are for representational purposes only. The actual hotels/resorts may differ from the images shown.

By confirming your booking, you are accepting on behalf of all persons travelling on this booking that the terms of this Agreement constitute the entire agreement between us with regard to your booking. Your contract with us shall be governed by and construed in accordance with the law of India. You agree to submit to the exclusive jurisdiction of the courts of Delhi (India) over any claim or matter arising under or in connection with your contract with us.

In event of any dispute/claims or differences arising out of the Vacations Ownership, the customer shall contact Vacations Hotel & Resorts customer service cell for mutual discussion and resolution.
